Mr. Low Song Kuan is an independent trial and appellate litigator with a proven track record across Malaysian courts. He completed his pupillage and practiced as a legal associate at Messrs. K. S. Pang & Co. for over three years before establishing his own practice. Having successfully navigated complex civil and criminal disputes, he brings versatile courtroom experience and a sharp analytical approach to high-stakes legal battles. While offering comprehensive legal solutions, Mr. Low focuses intensely on Commercial, Estate & Trust, and Employment law, regularly advising directors, shareholders, executors, and corporate employers. Debt Recovery
Acted for clients to recover debt for goods sold and delivered, services rendered, loans provided, arrears of rental and damages while also defended claims from the bank, contractors, developers and suppliers. Cases handled before include the following:
Chiang Ee Hang & Ors v. Green Enhancement Sdn Bhd (Civil Suit No: JA-22NCvC-60-04/2022, High Court)(Pending Appeal)
Represented the clients in the substantive fresh action to recover a friendly loan of RM1.5 million provided to the Defendant. Entrusted to take over the conduct of the case and led the trial independently in the 3rd year of practice and eventually secured a victory judgment in favour of the clients.
Green Enhancement Sdn Bhd & Ors. v. Chiang Ee Hang & Ors. (Civil Appeal No: J-02(NCvC)(A)-427-03/2022, Court of Appeal)
Prepared the brief and successfully defended the appeal at the Court of Appeal’s level after the High Court granted relief against disability to the clients under Section 8(1) of the Registration of Businesses Act 1956 to commence civil action against the Respondents for recovery of friendly loans following the registration of the clients’ partnership business had expired.
Green Enhancement Sdn Bhd & Ors. v. Chiang Ee Hang & Ors. (Civil Application No: 08(f)-558-12/2022(J), Federal Court)
Entrusted to independently conduct the case at the Federal Court and successfully defended an application for leave to appeal to the Federal Court on the same issue above and argued that the Court of Appeal’s interpretation on Section 8(1) of the Act above is in line with the object and intent of the Legislature and the established principles of statutory interpretation.

Familiar with enforcing judgments and orders such as the filing of bankruptcy, winding up petition, writ of seizure and sale, writ of possession, garnishee application and etc.
Corporate Litigation
Shakib bin Abu Bakar Banafee v. AWH International Logistics Sdn Bhd (Originating Summons No: JA-24NCC-14-06/2022, High Court & Civil Appeal No: J-02(IM)(NCvC)-2072-11/2022, Court of Appeal)
Successfully defended a logistic company from applications for inspection of accounts under Section 245 of the Companies Act 2016 and injunctions filed by a director of the company at the High Court and assisted senior counsels in arguing over the point of statutory right of director for inspection of accounts versus statutory and proprietary right and power of shareholder to remove a director. Also successfully resisted the appeal on the injunction application at the Court of Appeal’s level by having assisted senior counsels on the point that an appeal for interlocutory injunction becomes academic when the pre-existing cause of action has been dismissed or fails.
Estate & Trust Litigation
Forgery of will
Ho Hee Yik v. Tee Yen Chong & Ors. [2025] MLRHU 2862 (High Court) (Pending appeal)
Entrusted to conduct the case independently against the Defendants to invalidate an alleged will of the deceased wife. Led the trial during the 2nd year of practice involving a total of 11 witnesses and handwriting expert. Managed to secure an admission from a purported attesting witness during cross-examination that he in fact did not witness the deceased wife signing the will before him. Eventually succeeded in obtaining a declaration from the Court that the alleged will is forged, invalid, null and void and overcame the issue of non-registration of marriage between the couple raised by the Defendants on a salient point of law concerning the validity of existing Chinese customary marriage or common law marriage before the Law Reform (Marriage and Divorce) Act 1976 took effect.
Appointment of administrator & dispute on the extent of the estate
Lim Han Ming v. Lim Han Peng (Civil Appeal No: J-02(IM)(NCvC)-2034-12/2023, Court of Appeal)
Entrusted to handle the brief independently and successfully argued a favourable appeal outcome in part against the Respondent in the Court of Appeal for specific discovery of certain documents which are relevant and necessary for the just and expedient disposal of the siblings’ dispute over their late father’s estate.
Lim Han Ming v. Lim Han Peng [2026] MLRHU 366 (High Court)
Entrusted to handle the brief independently and co-chaired the trial with senior counsel in the suit concerning the appointment of administrator and the extent of the deceased father’s estate. Conducted extensive research and raised the salient points of law concerning the majority rule in the appointment of administrator, the principle on an executor de son tort, the principle of conflict of interest due to intimated claims against the contesting beneficiary based on English authority, defeasibility of title under Section 340(2) and 340(3) of the National Land Code on title registered due to fraud or misrepresentation or by means of an insufficient or void instrument, presumption of gift from father to children and prima facie evidence of ownership of a business based on the register of business. Successfully convinced the Court in allowing the client’s claims and dismissed the Defendant’s counterclaim in its entirety based on evidence and law.
Pang Shiao Yin & Ors v. Pang Woon Nyok [2025] MLRHU 2669 (High Court)
Represented the client to defend a civil action brought by the Plaintiffs to set aside a small estate distribution order issued by the Land Administrator pertaining to the deceased’s estate on counts of alleged misrepresentation and fraud after more than 30 years. Successfully convinced the Court that the Land Administrator holds exclusive original jurisdiction to hear matters relating to small estates and the High Court has no original jurisdiction to hear the Plaintiffs’ originating summons as a manner to bypass the appeal process provided under the Small Estate (Distribution) Act 1955 while also having established for the client his beneficial interest over the subject matter property on resulting trust.
Employment Litigation
Chee Kwan Yee v. Askoma Sdn Bhd (Civil Appeal No: J-01(A)-595-10/2021, Court of Appeal)
Assisted in the preparation of the brief in an unfair dismissal appeal and contributed the point that the Court cannot go into another reason not relied on by the employer when adjudicating an unfair dismissal inquiry and the Court is to enquire only into the reasons operating in the minds of the employer at the time of the dismissal based on the Federal Court’s decision in Maritime Intelligence Sdn Bhd v. Tan Ah Gek [2022] 1 MLRA 56. Eventually succeeded in overturning the High Court’s decision and won the appeal at the Court of Appeal in favour of the client on the unfair dismissal by the company.
Land Acquisition
Represented client in an inquiry hearing in connection to a compulsory acquisition by TNB. Cases handled include:
Ang Bung Huat & Ors v. Pentadbir Tanah Daerah Johor Bahru (Land Reference No: JA-15-42 & 43-12/2023, High Court)
Assisted senior counsels in land reference to the High Court to challenge the quantum of the compensation awarded by the Land Administrator and successfully secured an increase of around 20% in compensation for the clients with the assistance of a private registered valuer.
Construction Arbitration
Represented client and prepared the brief to defend claims from a contractor through the AIAC arbitration.
Construction Adjudication
Independently handled several CIPAA cases from the issuance of Payment Claim and Payment Response, registration of adjudication, filing of Adjudication Claim, Adjudication Response and/or Adjudication Reply within the strict timeframe for contractors who were not being paid for work done in construction projects. Represented client to set aside CIPAA award.

Dangeorus drugs offences
Kong Seng Long v. Public Prosecutor (Criminal Appeal No: 05(M)-24&27-02/2022(J), Federal Court)
Assisted senior counsel in preparing the briefs and representations in the appeals against 5 counts of drug trafficking and 1 count of drug possession. Managed to set aside the conviction and death sentence for all drug trafficking charges and substituted with 13 years of imprisonment on drugs possession.
Nnabueze Cornelius Agbodike v. Public Prosecutor (Criminal Appeal No: 05(M)-202-09/2019(B), Federal Court)
Assisted senior counsel in preparing the brief on application to review the death sentence affirmed by the Federal Court on the charge of drug trafficking under the Revision of Sentence of Death and Imprisonment for Natural Life (Temporary Jurisdiction of the Federal Court) Act 2023. Successfully reviewed the death sentence to 30-years’ imprisonment and 12 strokes of whipping.
Lee Boon Kwang v. Public Prosecutor (Criminal Appeal No: 05-14-01/2014(B), Federal Court)
Assisted senior counsel in preparing the brief on application to review the death sentence affirmed by the Federal Court on the charge of drug trafficking under the Revision of Sentence of Death and Imprisonment for Natural Life (Temporary Jurisdiction of the Federal Court) Act 2023. Successfully reviewed the death sentence to 30-years’ imprisonment.

Swee Chin Aun v. Public Prosecutor (Criminal Appeal No: 05-95-05/2012(K), Federal Court)
Assisted senior counsel in preparing the brief on application to review the death sentence affirmed by the Federal Court on the charge of drug trafficking under the Revision of Sentence of Death and Imprisonment for Natural Life (Temporary Jurisdiction of the Federal Court) Act 2023. Successfully reviewed the death sentence to 30-years’ imprisonment and 12 strokes of whipping.
Teh Geok Chin lwn. Pendakwa Raya [2026] 2 MLRA 624 (Court of Appeal)
Assisted senior counsel in preparing the brief in the appeal on the charge of drug trafficking to which it was pleaded guilty to by the client. Assisted in challenging the conviction to be unconstitutional and invalid based on the argued case of double-presumption. While the appeal was dismissed, it prompted the Court of Appeal to lay down careful guidelines and procedure when recording a plea of guilty to safeguard the fundamental rights of an accused person.

Toh Kian Peng v. Public Prosecutor (Criminal Appeal No: 05-27-02/2018(J), Federal Court)
Assisted senior counsel in preparing the brief on application to review the death sentence affirmed by the Federal Court on the charges of murder under the Revision of Sentence of Death and Imprisonment for Natural Life (Temporary Jurisdiction of the Federal Court) Act 2023. Successfully reviewed the death sentence to 36-years’ imprisonment and 12 strokes of whipping.
Teh Kim Hong v. Public Prosecutor (Criminal Appeal No: 05-130-06/2013(J), Federal Court)
Assisted senior counsel in preparing the brief on application to review the death sentence affirmed by the Federal Court on the charges of murder and kidnapping under the Revision of Sentence of Death and Imprisonment for Natural Life (Temporary Jurisdiction of the Federal Court) Act 2023. Successfully reviewed the death sentence to 40-years’ imprisonment and 17 strokes of whipping.
Lim San Muk v. Public Prosecutor (Criminal Appeal No: 05(M)-189-08/2019(J), Federal Court)
Assisted senior counsel in preparing the brief on application to review the death sentence affirmed by the Federal Court on the charge of murder under the Revision of Sentence of Death and Imprisonment for Natural Life (Temporary Jurisdiction of the Federal Court) Act 2023. Successfully reviewed the death sentence to 35-years’ imprisonment.
